General Passenger Vehicle Transportation Business Standard Conditions of Carriage

(Scope of Application)

Article 1

The Conditions of Carriage for the General Passenger Vehicle Transportation Business managed by our company shall be governed by these Conditions of Carriage, and matters not stipulated in these Conditions of Carriage shall be governed by laws and regulations or general customs.
2. If we accept a special contract for some provisions of this contract of carriage to the extent that it does not violate the purpose of this contract of carriage and laws and regulations, it shall be subject to the special contract regardless of the provisions of the clause.

(Instructions from Personnel)

Article 2

Passengers must follow the instructions given by our drivers and other personnel to ensure safe transportation.

(Acceptance of Transportation)

Article 3

The Company will accept the carriage of passengers unless they refuse to undertake or continue the carriage pursuant to the provisions of the following Article or Article 4-2, Paragraph 2.

(Acceptance of Carriage and Refusal to Continue)

Article 4

We may refuse to accept or continue transportation in any of the following cases.

  1. When the application for carriage does not comply with these Conditions of Carriage.

  2. When there is no equipment suitable for the transportation.

  3. When the applicant requests a special burden for the transportation.

  4. When the transportation is contrary to the provisions of laws and regulations, public order, or good manners and customs.

  5. When there is a transportation problem due to a natural disaster or other unavoidable reason.

  6. When the passenger does not comply with the measures taken based on the transportation regulations such as the passenger vehicle transportation business of the crew.

  7. When the passenger is carrying an item that is prohibited from being brought in by the provisions of the transportation regulations such as the passenger vehicle transportation business.

  8. When the passenger cannot clearly tell the destination or is so inebriated that the passenger cannot walk without the help of another person.

  9. When the passenger is wearing unclean clothes that may contaminate the inside of the car.

  10. When the passenger is a seriously ill person without an attendant.

  11. Patients with class I infectious diseases, class II infectious diseases or designated infectious diseases (limited to those requiring hospitalization) under the Act on the Prevention of Infectious Diseases and Medical Care for Patients with Infectious Diseases (including those considered as these patients) or when there is a finding of a new infectious disease.

Article 4-2

Passengers are requested to refrain from smoking in our non-smoking vehicles (meaning vehicles that indicate that they are non-smoking vehicles.) (The same applies below.)
2. If a passenger smokes or intends to smoke in our non-smoking vehicles, the driver may request that the passenger stop smoking, and if the passenger does not comply with this request, we and/or the driver may refuse underwriting or continuation of transportation.

(Fares and Charges)

Article 5

The fares and charges we receive are based on the approval of the Director of the Regional Transport Bureau at the time of the passenger's ride.
2. The fares and charges in the preceding paragraph are based on the displayed amount on the fare meter, except when it is an hourly rental contract.

(Collection of Fares and Charges)

Article 6

We require payment of fares and charges when the passenger gets out from the car.

(Responsibility for Passengers)

Article 7

We shall be liable for any damages caused by the operation of our cars when the life or body of a passenger is harmed.

However, when it is proved that our company and personnel were not negligent in the operation of the car and the car had no structural defects or functional impairments but there was intentional negligence on the part of the passenger or a third party other than the personnel of our company, then the above is not applicable.
2. In the case of the preceding paragraph, our liability to the passenger begins at the time of the passenger entering the car and ends with exiting the car.

Article 8

In addition to the provisions of the preceding article, the Company shall be liable for damages suffered by the passenger regarding their transportation. However, this does not apply when the Company and its personnel prove that they have not been negligent regarding transportation.

Article 9

If we do not temporarily suspend operations or take other measures to ensure the safety of transportation due to natural disasters or other reasons that cannot be attributed to us, we will not be liable for damages suffered by the passenger.

(Passenger Responsibility)

Article 10

We will seek compensation for damages from the passenger when the passenger is intentionally negligent, or when the passenger fails to comply with the laws and regulations or the provisions of these Conditions of Carriage.
